By accessing or using Farcash (the "Service"), you agree to these Terms of Service ("Terms"). If you are using Farcash on behalf of an entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, do not use Farcash.

Farcash provides a secure digital wallet tied to your verified phone number. You can send and receive stablecoins (digital currencies intended to hold a stable value) with other individuals or businesses. Farcash aims to make these transactions easy and straightforward: you do not need deep technical knowledge or a separate crypto app. We are not a bank or financial institution, and we do not provide investment advice.

You must be at least 13 years old to use Farcash. You must have legal capacity in your jurisdiction and a valid mobile phone number for account verification. You agree that you are not (a) on any U.S. government list of prohibited or restricted parties, and (b) located in a country subject to comprehensive U.S. sanctions. If you use Farcash on behalf of an entity, that entity must have the legal authority to use the Service under these Terms. You agree to provide accurate and complete information during account setup. You are responsible for maintaining the security of your account and phone. If we suspect any unauthorized access, we may suspend or close your account for security reasons.

You may use Farcash to create and manage your digital wallet, and to send or receive stablecoins with other Farcash users or participating businesses. You may also use Farcash to request payments or otherwise interact with supported features. You agree to use Farcash only for lawful purposes and in accordance with these Terms. Farcash may impose transaction limits, verification steps, or other conditions to ensure compliance with laws and security standards. We may share information with regulators or law enforcement if required by law.

• Any illegal activity, including fraud, money laundering, terrorist financing, or the sale of prohibited goods or services.
• Sending, receiving, or storing stolen, counterfeit, or unauthorized funds.
• Attempting to disguise or hide the origin or destination of funds (for example, using mixers, anonymizing services, or structuring transactions to avoid detection).
• Using Farcash for gambling, pyramid schemes, or any form of investment contract that violates U.S. law.
• Using automated scripts, bots, or other means to access or use Farcash without our permission.
• Impersonating any person or entity, or falsely claiming an affiliation with another person or entity.
• Sending spam, phishing, or unwanted communications through Farcash.
• Selling or renting access to your Farcash account or providing Farcash services to third parties without permission.
• Circumventing any transaction or account limits set by Farcash.

Farcash reserves the right to monitor usage and report suspicious activity. We may limit, freeze, or close accounts and transactions if we reasonably suspect any violation of these Terms or applicable law.

You use Farcash at your own risk. The Service is provided "as is" and "as available." Farcash makes no guarantees about the operation or performance of the Service. We do not promise that Farcash will always be available or error-free, and we are not liable for any delays or failures due to network issues, software bugs, or other problems outside our control. Farcash may occasionally need to suspend or restrict the Service for maintenance or compliance reasons, and we will not be liable if the Service is interrupted or will not be liable if the Service is interrupted or unavailable. Farcash is not a bank or financial institution. Funds in your Farcash wallet are not insured by the FDIC or any government agency. The stablecoins we support are digital tokens. Farcash expressly disclaims any liability for losses due to price fluctuations or market volatility. We do not provide legal, tax, or investment advice. You are solely responsible for any taxes or reporting requirements related to your use of Farcash. We encourage you to consult a professional for advice on your personal situation.

To the fullest extent permitted by law, Farcash and its affiliates will not be responsible for any indirect, incidental, special, or consequential damages of any kind (including lost profits, lost data, or lost goodwill) arising from your use of Farcash or your inability to use the Service. Our total liability to you for any claim related to Farcash, whether in contract, tort, or otherwise, will not exceed the amount you have paid us in the past 12 months (if any). Some jurisdictions do not allow the exclusion of certain damages or limitations of liability, so these restrictions may not apply to you.

You agree to indemnify and hold harmless Farcash and its owners, officers, and employees from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) that arise from or relate to: (a) your violation of these Terms; (b) your unauthorized use of Farcash; or (c) your violation of any law or the rights of another.

We reserve the right to suspend or terminate your access to Farcash at any time, with or without notice, for any reason (including suspected fraud or violation of these Terms). If your access is terminated, you must not attempt to access the Service again. You may also close your Farcash account at any time by deactivating it through the app or by contacting us. When your account is closed, we will attempt to return any remaining balance to you (for example, by sending your stablecoins to a specified address), after deducting any fees or liabilities. You should withdraw or transfer any stablecoins in your account before the account is closed; if you do not, you may lose access to those funds. We may delay or hold funds if required to comply with law or to protect against fraud or other risk. If your account is inactive for an extended period, we may close it in accordance with applicable state laws on unclaimed property. We will make reasonable efforts to notify you before doing so.

Farcash may update these Terms or change the Service at any time. We will notify you of significant changes by SMS or through the app and update the "Effective Date" above. If you do not agree to the updated Terms, you should stop using Farcash. Your continued use of Farcash after changes are posted constitutes acceptance of those changes.

These Terms, together with any policies or guidelines referenced herein, constitute the entire agreement between you and Farcash regarding the Service. If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in effect. You may not assign or transfer your rights or obligations under these Terms. These Terms are governed by the laws of the State of Delaware (without regard to conflict of laws principles). Any disputes arising from these Terms or the Service will be resolved in the federal or state courts located in Delaware.
